Guest Feature: Charitable Donation Accounts

Erin Ohern
Erin O'Hern, Director, League Compliance Services at Policyworks LLC.
The holiday season may be ending, but the season of giving is year-round. A tool that credit unions may find helpful to bolster their philanthropy is a Charitable Donation Account (CDA). In 2015, the Iowa Division of Credit Unions (Division) released an Interpretive Bulletin allowing credit unions to utilize CDAs under a new NCUA rule permitting this specific type of investment account. CDAs are hybrid charitable and investment vehicles that allow broader investment strategies than are generally permitted under credit union investment rules. Under the CDA rule 51 percent of the total return on investment must be distributed to 501(c)(3) non-profit organizations.

Keep in mind CDAs are investments that may carry additional risk so detailed due diligence will be needed. The Administrative Bulletin lays out the specific requirements credit unions must meet to take advantage of this alternate investment power. Before starting a CDA credit unions must apply to the Superintendent with a plan demonstrating compliance with the CDA requirements.
